Terms and Conditions
- Permission to reproduce and fees payable are for non-exclusive one-time web site usage (on one web site, for one year) only. Such use is limited to one-time reproduction at the URL specified in the contract. Such use excludes any reproduction in print or for the purposes of advertising, compact disc covers, calendars, television, motion pictures or film, color prints, reproduction of three-dimensional objects, brochures, annual reports, and other non-editorial purposes. Separate written application must be filed with the Smart Museum of Art for any and all additional use of images from the Museum’s collection. This agreement shall not be assigned or transferred. Any modification shall require permission in writing from the Smart Museum of Art.
Reproductions must be made only from color-corrected transparencies, digital files thereof, or curatorially-approved black and white photographs provided by the Smart Museum of Art. Reproduction from printed images, 35mm slides, color photographs, or photographic material obtained from other sources is not approved.
No bleeding or cropping of the image is permitted. The reproduction must be halftone black and white or four color and may not be reproduced on a colored background. No images may be superimposed on the reproduction, e.g. type, color, or another image. Any reproduction, which deviates from the original photograph, transparency, or digital file including, but not limited to, electronic manipulation renders this permission void.
Application to produce a detail from a work of art will be considered only upon receipt of a marked-up photograph or photocopy of a photograph showing the exact area to be used. The word “detail” must appear in the caption with a complete credit line.
Special permission is required if the reproduction is to appear as a frontispiece, chapter divider, book cover, or dust jacket or is not directly in the accompanying text. In such cases, an additional fee may be charged.
The reproduction shall be accompanied by a caption and credit line containing the following elements: artist’s name, title of the work of art, object date, medium, size, The David and Alfred Smart Museum of Art, The University of Chicago; the donor’s credit, Photograph © 20XX courtesy of The David and Alfred Smart Museum of Art, The University of Chicago. The full credit line must appear in immediate proximity to the reproduction or in the section within the publication devoted to acknowledgments. Abbreviations are not permitted.
The Applicant expressly understands and agrees that the copyright covering all photographic materials supplied pursuant to this permission is not assigned or released by the Smart Museum of Art, that the purpose of this permission is to grant only a non-exclusive license to use Museum materials for the use specified in this contract-invoice and that the Museum specifically reserves to itself all other rights in the photographic materials reproduced pursuant to this permission.
Permission to reproduce does not purport to include any rights that persons other than the Smart Museum of Art may have under the laws of various countries. It is the obligation of the applicant to secure written permission to reproduce from the copyright holder(s) of the original work of art. This permission must be forwarded to the Smart Museum of Art before photographic materials are released. The Smart Museum of Art assumes no responsibility for any royalties or fees claimed by the artist or on the artist’s behalf. The Applicant agrees to indemnify and hold harmless The Smart Museum of Art against any and all claims relating to the copyright of the original work of art being reproduced.
Photographic materials will be provided upon the full payment of assigned fees and the Smart Museum of Art’s receipt of duplicate executed contracts. Foreign payments must be made in U.S. dollars. Foreign payments may be paid by check, wire transfer or credit card (Visa or MasterCard). Upon payment, one copy of the countersigned contract-invoice will be returned to the applicant with the requested materials. No refunds are given for unused images.
The Applicant agrees to provide the Smart Museum of Art with two (2) copies of the publication or print/digital material. Physical copies can be addressed to Tim Porter, Assistant Registrar, Permanent Collections at the Smart’s physical address.
